1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of the website at theproteinchef.co (the “Website”) and The Protein Chef mobile application (the “App”), together with all related content, features, products, and services (collectively, the “Services”). The Services are operated by The Protein Chef LLC (“The Protein Chef,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Disclaimer, each incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian, who is responsible for your use. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

3. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it current. Notify us at support@theproteinchef.co if you suspect unauthorized use of your account. You may delete your account at any time from within the App. We may suspend or terminate accounts as described in these Terms.

4. Subscriptions and Payments (App)

The App offers an optional premium subscription that unlocks additional features.

– Price and billing. The premium subscription is an auto-renewing annual subscription priced at US $9.99 per year (or the equivalent in your local currency), as shown in the App at the time of purchase. Prices may change; any change will apply to future billing periods and will be disclosed in advance where required.

– Payment. Purchases made through the App are processed by Apple and charged to your Apple ID account. Subscriptions are managed through our subscriptions provider, RevenueCat.

– Auto-renewal. Your subscription automatically renews for successive periods unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period at the then-current price.

– Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions). Cancelling stops future renewals; you keep access until the end of the current paid period.

– Refunds. Payments are generally non-refundable except where required by law. Because purchases are processed by Apple, refund requests are handled by Apple under the App Store’s policies.

– Free features. Many features of the Services remain available without a subscription.

5. Store and Physical Products (Website)

Physical products purchased through our Website are sold and processed through Shopify and fulfilled through Printify and its print and shipping providers. Availability, pricing, shipping, and returns for physical products are subject to the policies presented at checkout. Title and risk of loss pass to you upon delivery to the carrier, except as required by law.

6. License to Use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape, sell, or commercially exploit our content (including recipes, text, images, and videos) without our prior written permission.

7. Content You Submit

The Services may let you submit content, such as recipe submissions, reviews, comments, photos, or other materials (“User Content”).

– Your responsibility. You are solely responsible for your User Content. You represent that you own or have the rights to it and that it does not infringe any third party’s rights, violate any law, or contain anything unlawful, harmful, or objectionable.

– License to us. By submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and display it in connection with operating and promoting the Services. For recipe reviews, you understand your review and display name may be shown publicly.

– Our rights. We are not obligated to use, and may remove, any User Content at our discretion.

8. Acceptable Use

You agree not to: use the Services for any unlawful purpose; attempt to gain unauthorized access to any system or account; interfere with or disrupt the Services; reverse engineer, decompile, or attempt to extract source code except as permitted by law; use automated means to scrape or harvest content or data; or use the Services to transmit harmful, infringing, or objectionable material.

9. Intellectual Property

The Services and all content available through them, including recipes, text, graphics, logos, images, videos, and software, are owned by or licensed to The Protein Chef and are protected by intellectual property laws. “The Protein Chef” and related marks are our trademarks. Except for the limited license in Section 6, nothing in these Terms grants you any right in our intellectual property.

10. AI Features

The App may provide ingredient-substitution suggestions generated by artificial intelligence. These are provided for general informational purposes only, may be inaccurate or incomplete, and are not a substitute for your own judgment. See our Disclaimer for important information about recipes, nutrition, and ingredient suggestions.

11. Third-Party Services and Links

The Services rely on and link to third-party services (for example, Apple, Google, Supabase, RevenueCat, Shopify, Printify, Mediavine, and others). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services or content.

12. Disclaimers

The Services and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Recipes and nutrition information are for informational purposes only and are not medical advice; see our Disclaimer.

13. Limitation of Liability

To the fullest extent permitted by law, The Protein Chef and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100.

14. Indemnification

You agree to indemnify and hold harmless The Protein Chef and its owners, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. You may stop using the Services and delete your account at any time. Provisions that by their nature should survive termination will survive.

16. Changes to the Services and Terms

We may modify or discontinue the Services, or update these Terms, at any time. When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire, and you consent to their jurisdiction, except where prohibited by law.

18. Apple App Store

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and The Protein Chef, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to furnish support or maintenance for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. Your use of the App must also comply with the App Store Terms of Service.
